Beacon's City Council Announces Passage Of Law Prohibiting Evictions Without Good Cause - Mayor Votes Against - Council's Responses

On Monday, March 7, 2022, Beacon’s entire City Council voted to pass a law prohibiting residential evictions without good cause, known to some as the “Good Cause Eviction Law.” Mayor Lee Kyriacou, who is a landlord, voted against the law. The press release prepared by Beacon’s City Council has been provided in full below.

Beacon’s Eviction Without Good Cause Law accounts for many situations, including requiring landlords to provide good cause to raise the rent above 5% if contested by their existing tenant requesting proof of necessity if the tenant/landlord discussions break down and the landlord pursues going to court to let a judge decide on the legality of the rent increase.

Where Is This Law Coming From?

Beacon is joining in the national movement within the housing crisis for all people to not let long-term rentals be a cut-throat rental market business model anymore. Other municipalities in this area have crafted and signed similar legislation, including Newburgh, Kingston, Poughkeepsie and Albany. Each of those communities, including Beacon, experienced the decimation of many of their historic buildings during the federally funded program Urban Renewal, which ended up mattering when rent regulation laws were enacted. Albany currently has one lawsuit against it, brought on by three landlords and their companies, asking for the law to be rescinded, as reported in the Times Union. There is proposed legislation in New York State Legislature that would enact a similar measure statewide.

It is in part because of that destruction that these communities cannot enact forms of rent stabilization found in New York City today. A new law in New York State, the Emergency Tenant Protection Act of 2019, allows for a declaration of a housing crisis in a locality, but is based on having a number of historic buildings still in tact. However, as has been especially demonstrated in the past several years, laws are created, and laws are walked back upon when levels of harm are represented by groups of people advocating for change.

Residential Real Estate As A Business Model

During this process of legislative debate, advocates for Beacon’s law stressed that housing is a human right and needs more protection. Landlords who showed up to public meetings to speak answered that money they invested in a property is their retirement plan and should not be impeded upon. However, price hikes in any business model usually proves bad for business, and results in a client-business breakdown. Some Beacon landlords showed up to speak in favor of the law.

Even in the short-term rental market, or a client-services market - if a client is used to paying one price over a long period of time - to suddenly hike that price usually ruins the business/client relationship. In the housing market, the long-term landlord may replace the tenant quickly in an unregulated market, but in the equally unregulated service or even the short-term rental industry which has online reviews tied to it, pricing is regulated by online reviews (social pressure), proper business relationships, and providing great service. Because secure housing is such a desperate need, some residential landlords don’t often face social pressure to keep rent increases stable, or provide stellar service in some cases.

Said the lead author of the law, Councilmember Dan Aymar-Blair, to A Little Beacon Blog about the passage of this law: “Tenant-landlord issues are most often resolved out of court and I hope that continues. The law has clear definitions of what constitutes good cause eviction and that framework can be used for discussions before anybody has to go to court. I hope landlords and management companies that depend on abusing tenants for profit margins will see their business model won't work in Beacon.

“I hope that Beacon will next come together to address the lack of affordable housing for all income ranges. Good cause eviction means that tenants can organize and participate without fear of retaliatory evictions and jacked rents.”

Was This Vote Expected This Night?

The week prior, The City Council was not anticipating voting on the law on March 7th. Week after week, the law had been pushed forward by the Council to even get it to the stage of Public Hearing, which is where it was the Monday evening of this week. For months, the City Council heard resistance from its retained legal counsel, Keane and Beane, who also represents developers building rental units in the City of Beacon, to advise the City not to create a law, stating on public record that it would be difficult to defend if a lawsuit was brought against the City. The Council then discussed the possibility of hiring a different law firm to represent a lawsuit in that case, should that happen.

Beacon’s City Administrator Chris White stressed throughout several discussions his concern for “fiduciary” spending of taxpayer dollars on legal costs defending this law. It is not clear on his definition of fiduciary, since he has currently authorized at least $110,000 of taxpayer dollars in the pursuit of terminating employment of a longtime city employee of the Highway Department, in addition to over $50,000 in paid-leave salary for that employee to not work during a labor shortage.

This law was in its second round of Public Hearing, where anyone in Beacon could come speak their mind about it. With this law being discussed on social media and out in real life for several months, it was hard for the community to ignore the effort. Landlords came to speak in favor or against, as did tenants. Advocates for the law even held a holiday caroling/protest in December 2021 at Pohill Park, which marched to City Council to confront the then City Councilmembers during their last days on council before the new members started.

Self-Fulfilling Prophesy Of Rent Hikes Before The Law Passed

After at least one tenant came forward to public City Council Meetings to speak in favor of the law, word circulated that some landlords had begun raising rents in anticipation of the free-for-all rent hike situation getting regulated.

That Beacon tenant reported at the next Public Hearing, that after she spoke in public at a City Council Meeting, she had subsequently asked her landlord to fix something necessary in her apartment, whereby she received by text from her landlord saying that he would fix it. In the same text, he declared he was also raising her month-to-month rent by $600/month. This hike, after an agreed upon hike of $100/month over the summer, resulted in a $700/month hike within one year, she told A Little Beacon Blog. This renter is White, works in the non-profit sector, and volunteers to teach classes in a corrections facility in the evenings.

Usually, if the City Council expects to vote on a legally binding resolution the night of the closing of a Public Hearing, the Resolution is noted in the official Agenda for the City Council, and a vote is taken that evening. This can be fore anything simple like having a Public Hearing for allowing firefighters to live further away from Beacon, hearing from the community, and then voting affirmatively right after if the public doesn’t bring overwhelming objection.

But this vote wasn’t on the evening’s agenda after the Council closed the Public Hearing, yet they discussed putting it on the agenda during the opening of the meeting. A Little Beacon Blog asked Councilmember Dan if the Council expected to vote that evening. He answered: “Yes. When we started to hear that landlords were retaliating against renters, we had no choice. Seeing that the outstanding amendments would have weakened the law and allowed this retaliation to continue for another month, we pressed forward.”

When asked if he was surprised to see it not initially on the agenda, Councilmember Dan answered: “No, it wasn’t an issue.” You can listen to how they all discussed putting the vote on the agenda at the beginning of the City Council Meeting here.

When Did This “Eviction Without Good Cause” Movement Start?

In the Before Times, during the pre-pandemic days, and during the former administration under Mayor Randy Casale, rents were already on the rise in Beacon. Former Councilmember Terry Nelson suggested pursuing the Emergency Tenants Protection Act of 2019. During that administration, where Lee Kyriacou was then a Councilmember, the common response by then Mayor Casale and some councilmembers to Councilmember Terry’s urging was that rents would self regulate under market conditions.

When the new administration came in, with former Councilmember Lee Kyriacou winning the election to become Mayor, the new Mayor Lee Kyriacou gave a platform for the Emergency Tenant Protection Act of 2019 to be considered, after Councilmember Terry continued to bring it up. Mayor Lee would state that he was doubtful that Beacon qualified for the tenant protection. Yet he dedicated space at a public Workshop Meeting for expert opinion to explain why Beacon did not qualify.

The Emergency Tenant Protection Act of 2019 requires a locality to know its rental vacancy rate, and of those, that the buildings are ones built between February 1, 1947 and December 31, 1973. Many of Beacon’s buildings that were of that age had been bulldozed during the federally ordered Urban Renewal period. You can get an introduction to Urban Renewal from the blog Newburgh Restoration, who describes it as a “tragedy” when mentioning how 1,300 buildings were demolished there, 9 streets “plowed under,” and “The city’s African American community was uprooted, with thousands of businesses and residents displaced.” A similar situation happened in Beacon. The Emergency Tenant Protection Act of 2019 requires that these buildings still exist to qualify.

During the time of Beacon’s Emergency Tenant Protection Act of 2019 discussion, Mayor Lee also stated that Beacon does not have a housing survey to know its vacancy rate. He did not imply that Beacon was in a hurry to conduct such a study. However, he did support spending at minimum of $50,000 on a Parks and Recreation study to be told what people want from a central Community Center. Two such centers used to exist in Beacon, and Beacon’s current tiny Parks and Rec building at 23 West Center Street is bursting at the studs with services and volunteerism.

The City Council’s pursuit of more tenant protections continued, with Councilmember Dan Aymar-Blair pushing to have a Good Cause Eviction Law considered. Councilmember Dan took the lead on drafting the law with other Councilmembers and the City’s retained law firm, Keane and Beane.

A Little Beacon Blog reached out to former Councilmember Terry Nelson to get his take on the passage of this law, and if he thought his early efforts helped from years ago. He responded: “It’s not really for me to say if my efforts helped, but I would like to think they did. It’s always a good thing when renters get the protections they deserve. But any law only works when there is effective enforcement. Attention must be paid to the level of enforcement of the new law.”

What Some City Council Members Said Upon Voting

Before casting his vote of Yes, Councilmember George Mansfield, who consistently voiced concern about leaving renal rates in the hands of a judge on a case-by-case basis, said this to explain his vote in favor of the passage of the law:

“This is a complicated issue, and I appreciate everyone who has come out during the course of this discussion.

“I'd like to first say that Keane and Beane, our lawyers, have represented this community and looked out for them for as long as I've been on council - or maybe I've been here longer than Keane and Beane has, but. So I truly respect your advice and consider that greatly in my decision.

“I also think, that I can see through our discussions, that we have an opportunity to respond to Albany - that there might be an opportunity - I don't feel like we are risking an expensive lawsuit going forward - that we can respond.

“I would have preferred to wait for the Albany decision to come down. But I think we have time to respond between maybe passing this and actually going to quote and the cost of litigation associated with that.

“One of my goals when we pass a law such as this is to help as many people and to hurt as few people in the decision. And in the end, no one is fully happy, and no one got fully what they wanted out of these discussions.

“I think that there is an urgency right now, certainly listening to some - part of the urgency is created not only by the greed, but by the fear of this law being passed. I think that is what is happening to some people. Landlords are raising rents objectionably and unconscionably right now. They've been known to do that in the past as well.

“My decision tonight will be based on helping as many people and hurting as few people going forward. Thank you all for being part of this conversation.

Mayor Kyriacou had this to say before casting his lone vote of No:

“The issue that I have respect to authority is that I have been sitting on Council for a long time. The nature of how City's get their authority from the State is not supported in this area. I'm sorry, but that is what it is. You all may have a different view, and I'm very respectful of that view.

“The second of my concern is, if we are picking away to help renters, and I think we do need to help renters, pitting one part of the community against the other is the wrong way to do this, and this does exactly that. Which I find that just sad.

“I know we want to help renters. Again, the County has announced a rental support program for people in low-income. That I think is the correct approach. It's something that we all as a community pay taxes to support, and I'm supportive of that. Pitting one part of the community against the other is the wrong way to go. I'm just saddened as I listen to us just dividing ourselves.

“The ones that I am focused on helping is low-income renters. There are plenty of renters that have come to Beacon who are fully capable of paying the full rents that are out there now. That's why those rents are out there. If we afford them the same rights, they will push low income renters out, and that's the group I really, really wish to help. I don't think this law is structured correctly do to so. Those are my concerns.”

In answering the Mayor, Councilperson Justice McCray gave their answer before voting in favor of the passage of the law:

“To that point, this law is designed to keep people in their homes, so I don't see how this would push low-income renters out,” Justice said.

“Just to talk about eviction:

“Evicted individuals are 11% to 15% more likely to experience a loss of employment and medical insurance as compared to individuals who have not been evicted (Harvard University)

“Children victimized by eviction are typically forced to transfer schools; a traumatic destruction of stable educational and peer relationships that has been shown to have a lasting negative impact on childhood development. (National Education Policy Center)

“All adult populations, once evicted, experience higher-all cause mortality, increased instances of emergency room visits, higher rates of addiction and relapse, depression, and suicide. (National Library of Medicine)

“Cost-burdened households spend more than 30% of their income on rent, and severely cost-burdened households spend more than 50% (Disrupted)

“I came onto Council as a community organizer working in social and racial justice. Passing Good Cause is crucial for bringing racial justice to housing. More than two-thirds of Black families in New York State rent. Among renters, Black households are the most vulnerable to eviction, the most likely to experience discrimination from landlords, and the ones most likely to be displaced when neighborhoods change.

“High rents and gentrification have had a devastating impact on Black communities in New York State. In my social justice work over the past couple of years, I’ve built connections with Black members of our community who lived here for years, and because they weren’t protected by this law, they’re gone. I don’t get to walk around the corner and share meals with them anymore. If you’ve been here for not even 10 years, you’ve seen the active displacement of Black people in Beacon. Good Cause is an important step in promoting community stability and combating displacement.

“According to a study published last week by the Pratt Center for Community Development Urban Democracy Lab, Legal Aid Society, Housing Justice for All, and the Community Service Society: “Black Households In New York Are 3x As Likely To Face Eviction As White Households”

“Councilmembers and community alike have stated that housing is a human right. It’s not just a philosophy. Universal Declaration of Human Rights Article 25: Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, and housing…

“I support Good Cause Eviction.”

The Press Release From The City Council After The Vote

Below is the press release from the City Council, that has not yet been published to the City’s website yet. In earlier discussions as the law was debated, City Administrator Chris White asked the Keane and Beane attorney if the law, if voted on, could be delayed to be published to the City Code and delay enforcement, to which the attorney answered that it could. It has not been stated as to the date that this law will be published to the City Code.

BEACON, NY MARCH 8, 2022 - In last night’s City Council meeting, the Beacon City Council passed their hard-fought “good cause eviction” law tonight with the support of all six City Council members. By providing Beacon’s housing court with a framework for what constitutes an eviction with good cause, the City Council hopes to end the leniency of eviction proceedings against tenants, allow greater access to due process, and mitigate the displacement of residents. The law builds upon the fact that housing is a human right and that apartments and houses are not just commodities, they are homes.

“To clear up misconceptions, this law does not change that evictions require the courts. What it does is sets relevant standards for the proceedings that protect tenants,” said Wren Longno, Ward 3 Councilmember.

Specifically, grounds for eviction with good cause include:

  • Non-payment of rent

  • Substantial lease violations

  • Property damage

  • Committing a nuisance

  • Refusal of access

  • Illegal activity

  • Bad-faith refusal to sign a written lease

  • If the landlord wants to move themselves or a family member into the rented unit.

  • Additionally, rent increases above 5% will require a justification before a judge in cases where the tenant objects to the increase. The law intends to end the practice of arbitrary evictions and steep rental increases which are de facto evictions.

“Beacon is a popular place to live, and with good reason, but increased rents of 20% or more have become common which is simply impossible for most people.” said Councilmember At-Large Paloma Wake “While this law does not directly address affordable housing per se, we know that stable housing has compounding benefits for the entire city. When basic needs are met, individuals can be more active and thriving members of our community.”

Since Councilmember Dan Aymar-Blair for Ward 4 first introduced the law in August 2021, neighboring communities of Newburgh, Poughkeepsie, and Kingston passed their own similar versions of the law.

While no legal action has been taken against these municipalities, over several workshops, the City Council discussed the potential of a lawsuit brought by landlords. The City Council concluded that the risks posed to the city by a lawsuit were low, particularly the threat of legal expenses.

“Passing Good Cause is essential for bringing racial justice to housing,” said Ward 2 Councilmember Justice McCray. “More than two-thirds of Black families in New York State rent; and among renters, Black households are the most vulnerable to eviction, the most likely to experience discrimination from landlords, and the ones most likely to be displaced when neighborhoods change. If you’ve been here for not even 10 years, you’ve seen the active displacement of black people in Beacon. Black households in New York are three times as likely to face eviction as white households. Good Cause is an important step in promoting community stability [preserving diversity] and combatting displacement.”

Similar laws are still being considered around New York State, including New Paltz and Ithaca. A statewide bill is also actively under consideration.

“Tenants can now organize and speak up about their living conditions without fear of retaliatory evictions and jacked rents,” said Aymar-Blair. “Now that the folks who depend on affordable housing can fearlessly join the conversation, the City Council is ready to turn its attention to creating new affordable housing for low-income residents and working families.”

Molly Rhodes, Ward 1 Councilmember said, “We hope this can be a launching point where both tenants and landlords feel inspired to come together to help the city craft future housing policies and vision.”

“Pitting One Part Of The Community Against The Other” - Governing Laws Already Do This

One of Mayor Lee’s stated concerns is for avoiding this legislation is to avoid “pitting one part of the community against the other,” implying tenants vs landlords. This type of “pitting” has already existed in the form of legislation in New York State, especially so in New York City and parts of Albany, Erie, Nassau, Rensselaer, Schenectady, and Westchester counties where rent control is still in effect, according to the Residential Tenants Rights Guide. These members of the community are already pitted against each other when the landlord pursues going to court to evict a tenant - if it reaches that point, and the tenant doesn’t self-evict.

A Little Beacon Blog has spoken to people who work in different areas. Families who have the same job year after year - fixed income if you will - who cannot afford a large rent increase - and then need to move out of Beacon to Wappingers or Newburgh to find comparable rent. Nurses. Home care workers. Self-employed creators. Service-industry folks like bar tenders and restaurant managers can barely afford to live in Beacon, yet they work here. Some commuting from counties over. “Artist lofts” are very limiting for who qualifies to live in those units, and can be discriminatory.

It is unclear who these low-income people are that Mayor Kyriacou says he advocates for, since the people he seems to say can pay these rising rents may be from certain private sectors, or people who rent apartments as second get-away homes, or are never home because their jobs who can afford this rent send these new Beacon citizens to other locations to do their jobs. Or, are the blessed collection of employees who can work remotely from home.

Keeping You In The Loop: Recap of City Council Meeting 8/20/2018

Every week or thereabouts, usually on Monday evenings, the Beacon City Council meets for one of two types of meetings:

  • An official meeting, where City Council members can vote things into law that impacts Beacon residents - for better or worse.
  • A Workshop, where they talk about recent issues typically raised by citizens at those meetings or by phone calls or emails, and hash out what might become a law.

The City Council meetings are where all of the things get decided. It's how rules end up in the code books that you wade through when trying to figure out if you need a permit to build a new porch, or if a large new building on Main Street needs to have a sign with its permit posted in public (just like houses do when under construction).

Meetings On TV

You can watch all of these meetings on TV on your Public Access Municipal Channel (if you still have cable). But if you miss a single meeting, you fall behind on a lot of meat. Fortunately, the Highlands Current sends a beat reporter, Jeff Simms, to regularly cover the meetings and report back on recent developments. He condenses an impressive amount of information into one short roundup article. Unfortunately, he is restricted by available print space. In the blogosphere,  however, we can go on... and on...

Junior Police Academy Graduation Presentation
This was a camp listed in our Summer Camp Guide that provided an opportunity for local kids to learn about law enforcement for one week during the summer. Local eateries donated lunch, and students did everything from obstacle courses to going on field-trips to different offices. Before the meeting got started, a different student spoke before the council to describe what they did each day.

Public Hearings Heard That Night

Public Hearings are your chance to voice your concern right before the City Council is going to write something into law.

PUBLIC HEARING HEARD THAT NIGHT:
On a local law to create Chapter 97 and amend Chapters 192 and 223 of the Code of the City of Beacon concerning Driveways

Sounds boring, right? Driveways - just another thing to get permission to fix! Turns out, Beaconites did need to adhere to some code before creating their driveways, but they didn't need to get a permit aka official permission. Plus, the regulations that residents did need to adhere to were located in three different places. The Council wanted to change that and make it easier to find and read.

According to Mayor Casale, "The only thing that was ever on the books in the City Of Beacon was that if you wanted to put a driveway in, you had to be a certain amount of feet from the property line. Over the last year or so, [new] driveways were put in [by residents] and it became controversial. So we decided, like other communities, to have a permit to put a driveway in that would be addressed in our code, and reflect the zoning law."

The Council wanted to know when a driveway could cut into their own streets, and that it adhered to some rules. They hammered out what the condensed and simplified law would look like in a Workshop Meeting back on June 11, 2018, and this August meeting was the Public Hearing on it to hear from the public to see if the public brought any ideas to the table. No one came to this Public Hearing, so it's moving on into the next stage of getting voted on to be turned into law.

Mark your calendar, because if you want to hop into the discussion about a major issue being made into law or amended, this is your big chance. If you want it or don't want it, come on down. Sometimes, only the side that doesn't want it comes down, or vice versa. So if you support an issue or don't, come down to the Municipal Building (near the train, overlooking the Hudson River) to say why.

PUBLIC HEARING September 4, 2018:
1.  A resolution to schedule a public hearing on September 4, 2018 to receive comment on proposed resolution to amend the language in Section 223-41.21 B(1)(b) of the Code of the City of Beacon concerning the Linkage District

This means that rules governing the area down near the train station - which is hot for development right now - have been worded in such a way that they are keeping a type of company that the City wants to be there, from being there. The example company that triggered this is Docuware, a document management company. Originally, Docuware wanted to relocate to the first building on Main Street that currently houses the Beacon Creamery.

As an aside, according to Ron at the Beacon Creamery, his landlord was going to move him up the street for a year during construction, and then move him back into a space that would have been made larger for his ice cream shop. Ron had been looking forward to the change.

Now Docuware is looking at property in the Linkage District near the train station, specifically where the auto shop is, and Spire Studios, the studio workspaces of several artists. You may have stepped inside this building during this year's and previous Beacon Open Studios.

The original language was written to keep out big box-type stores, but it has had the effect of keeping out other types of business that the City does want. According to Anthony Ruggiero, the City Administrator: "When we looked at the regulations, it was disjointed as to how it was adopted. Intent was to have mixed-use development. The way it was written, it was required to have two buildings. Total of buildings would be 25,000 square feet. When John [Clarke, the City's Planning Consultant] looked at it, the Comprehensive Plan was trying to prevent Big Box, but not mixed-use. The proposal coming to the Council would be two floors commercial, two floors residential."

PUBLIC HEARING September 4, 2018:
2.  A resolution to schedule a public hearing on September 4, 2018, to receive public comment on a proposed local law to amend Chapter 211 of the Code of the City of Beacon concerning Parking and Traffic Issues
This translates to proposed Stop Signs and No Parking Signs at the following places, as requested by citizens who wrote in:

  • Stop Signs on Monell Place (near Tompkins Terrace)
  • Adding No Parking to Dewindt and South Chestnut Street (near St. Rocco's)

PUBLIC HEARING September 4, 2018:
Last Minute Addition: A special Public Hearing to discuss proposed new apartments for 21 South Avenue.
This is the former Martin Luther King Center and is now owned by St. Andrew and St. Luke Episcopal Church. 

Local Laws and Resolutions

3.  A resolution to approve a memorandum of understanding for intermunicipal collaboration to promote sustainable water and wastewater systems

4.  A resolution authorizing the Mayor or City Administrator to sign an agreement authorizing and supporting the joint municipal land use review for the future redevelopment of the Beacon Correctional Facility.
This just means they can review proposals for this land. According to the City Administrator, eight ideas have come in, and one RFP that didn't work.

5.  A resolution awarding the contract for a Concentration Tanks Drive replacement to Rebuild-It Services Group, LLC.
Translates to: You're Hired!

WHEREAS, Kearney Realty Group, Inc. proposes to form an affiliate of the Kearney Realty Group which will be a single payer entity; and
WHEREAS, the present members of the Kearney Realty Group are Ken and Jean Kearney; there have not been any changes to Kearney Realty Group since the closing and there will be no changes to the members until such time the closing of construction and a certificate of occupancy is issued for this building,"

Some Highlights From Previous Summer Meetings

Even though most of us were on vacation or doing summer things, the City Council marched on and hashed out topics. Some highlights of what happened:

  • The metal trash cans on Main Street have been an issue with the public, in that they overflow. This was discussed months ago when Royal Carting, the city's trash collector, attended the meeting to present their estimate for trash and recycling pickup. New designs of trash cans were discussed. A most recent decision was that the tops of the trash cans would be replaced, so that there will be a larger hole for trash only, and not recycling.
  • Recycling is becoming problematic and is now costing the city money. It used to be that the City of Beacon actually received money for their recycling. But now the city is paying money to have the recycling done. According to James Constantino, the attorney representing Royal Carting: "The cost of recycling materials primarily from China has dropped dramatically," he stated at a City Council meeting on May 29, 2018. Plus, "contaminated" recycling, which is when trash (like food or plastic bags) gets into recycling, costs more to get rid of because it needs to be sorted. According to Mayor Casale also at that meeting: "The whole recycling market right now is topsy-turvy... Most of the county is not considering doing recycling anymore." A Little Beacon Blog covered this in greater detail when Beacon went to weekly recycling pickup in 2016.
  • Two new police officers were hired, including one woman. One new fireman was hired full-time after being a volunteer for several years.
  • New apartment and office buildings at 248 Tioronda had representatives back at the podium presenting their vision. Details can be found in this article.
  • New free bus service! The Dutchess County bus that goes west down Main Street, circles around the train station, then heads all the way to the mountain may be free starting Wednesday, August 22, 2018. It used to be called the G Line and now is called the Free Line. One of the buses is wrapped in a cheerful light blue decoration. This has BeaconArts' stamp on it, and we'll be producing an article to shed more light. Basically, this bus is free, and apparently you can hail it from any safe spot on the street.
  • Council Person Amber Grant wanted the people in her Ward 4* to know that the polling location for them to vote in the Primaries has changed. The new polling location is 50 Liberty Street, which is the First Presbyterian Church near the Lofts at Beacon Falls. The new voting date for everyone is Thursday, September 13, 2018. Not sure what ward you are in (i.e. which district you live in and which city council member represents you)? Visit this link to see where you need to go to vote:

Latest Changes to Draft Legislation for Airbnb in Beacon, NY (Short-Term Rental)

The Beacon City Council has made changes to the proposed legislation it is currently considering, to regulate short-term rentals by homeowners, commonly referred to as Airbnb-ing one's home. These changes are being discussed today in a City Council workshop meeting. The topic is #4 on the workshop agenda, which includes a dozen other areas for discussion. You can see all of the changes here at the city's website in red underlines and strike-throughs in the link called "Short Term Rentals LL."

The city has received a lot of public feedback about short-term rentals and Airbnb spaces in Beacon. The topic was first discussed in 2014, and with the city's skyrocketing popularity, addressing lodging space has only become more urgent. Since the City Council began to revisit potential short-term rental legislation, the following major changes have appeared in the public draft of the proposed city law. It would be the first of its kind for Beacon, and will be discussed at tonight's City Council workshop.

  • Language was removed from the overall introduction of the law that implied that short-term rentals in and of themselves cause bad behavior and disruption to neighborhoods at large.
  • "Non-owner" specification added to the determination that short-term rentals are inconsistent with the use of a residence for residential dwelling purposes.
  • Campers, garages, sheds, and other structures not approved for residential use - temporary or permanent - remain un-rentable in short-term residential situations.
    Editor's note: Just as an FYI, businesses that rent campers on their property, such as Kate's Lazy Meadow in the Catskills do exist, and require their own sets of business and insurance filings.
  • "Owner" has been more refined to exclude "entity corporation, limited-liability company, partnership," in addition to other forms of entities like a trust, or guardian of an estate.
  • Spaces available as rent-able have been more defined.
  • Requirements of the owner to show where the house has been advertised have been reduced.
  • Owner-occupancy remains the required status, which means that people would not be able to rent out a second or third home they owned on a short-term basis. The home would need to be the primary residence of the owner.
  • Weddings, concerts and other commercial uses of a property would remain unlawful for short-term rental.
  • The 100 days per year maximum amount of rental days has been removed. Nearly everyone who spoke at the public hearing for short-term rentals was opposed to that maximum. At that meeting, Council Member John Rembert voiced a request to "revisit the 100-day" maximum.
  • Permits would be required once the law is signed, and those who already rent out would have "45 days to file an application to obtain a short-term rental permit and 90 days to receive such short- term rental permit before any violations are issued" by the Building Department, unless the Building Department gets delayed.

Legislation on the Table (not the kitchen table) for Airbnb Short-Term Rental Limits

Beacon has stepped up to the plate once again to consider creating legislation for short-term rentals in people's homes, also known as "home sharing," or "Airbnb-ing". Mayor Randy Casale has cited emails he has received from citizens who are opposed to short-term rentals in different capacities. Beacon considered legislating this in 2014 and created draft legislation in 2015, but never finalized it. Click here for a background of this Airbnb issue and why it is being discussed now.

In January and February of 2018, Beacon discussed short-term rentals at a City Council meeting, and held a Workshop discussion on the subject in February. In April, members of the public were invited to voice their opinion at a Public Hearing, at which over 20 people spoke favorably about their experience with short-term rental via Airbnb. They also expressed their reactions to the proposed restrictions in the proposed new law put together in 2018.

A handful of people showed up to speak out against short-term rentals, and voiced their desire for rules to be enforced - even though no local law exists yet in Beacon to be enforced. The law on the table right now is new. There are zoning laws at the New York state level, which include fire safety requirements such as installing sprinkler systems or breakaway windows. Those requirements can be a financial burden to homeowners, who also rent out their homes to earn extra income to keep up with their mortgage or rent payments.

Those in opposition of no regulation at all included a citizen, Elaine Ciaccio, who submitted a petition she started which had 70 signatures on it asking to "1. Ban non-owner occupied whole home short-term rentals and 2. Require registration and establish regulations that maintain the zoned character of our residential neighborhoods." Airbnb has submitted their written response to Beacon's legislation, which was to argue against many of the proposed restrictions. Neither the petition or Airbnb's testimony were read aloud at the Public Hearing, but around 30 people voiced their opinions, a majority of whom were homeowner/landlords of short-term rentals who were in favor of short-term rentals, and in favor of the least amount of regulation - if at all.

Legislation on the Table Now

LEGAL NOTE: Please know: this summation does not constitute as the draft legal document. You can find that legal document right here at this link. The information has been summarized so that you can see the points quickly. You should read the draft legislation yourself if this area of legislation concerns you. The people of a municipality do not have a lawyer representing them, as a city hires an attorney to represent itself. Council members may not necessarily be lawyers or specialized in a type of law being legislated. As a citizen, homework is involved.

Here is a summary of the law that the City Attorney has drafted as of April 4, 2018. Please see the actual draft of the law at the City of Beacon's website in their PDF here at this link. This draft is an edited version that the attorney made prior to the Public Hearing on April 2, 2018, and includes "track changes," which means that you can see what was originally proposed or how something was worded, and then was revised based on feedback.

Men's Rights

Before we begin, it is noted that women were not always included in the legislation wording. Women and men have since been written into the draft with both pronouns, "his or her." In prior draft laws, the male pronoun has been used, such as "his property." Being that married women used to not be able to own property at all in the United States prior to the 1830s, with different states coming on board with allowing women to own property through the 1840s '50s, and so on until the late 1800s (see Wikipedia for all the details).

In this latest April 4th draft, one possible loophole remains for women in this line item: "A short-term rental permit has been issued and the owner fails to continue to occupy the premises on a continuous basis as his primary residence; or..."

Additionally, the proposed legislation assumes that the Building Inspector, who is currently a man, will always be a man. The legislative wording reads as this: "The applicant shall be given an opportunity to present evidence why such denial of application, or such suspension or revocation of the license, shall be modified or withdrawn. The Building Inspector or his designated agent may also present evidence."

Who is an Owner?

According to the draft legislation, an owner would be defined as: "An individual or group of individuals who are in possession of and have a fee interest in real property. The term 'owner' shall not include entity corporation, limited-liability company, partnership, association, a trustee, receiver or guardian of an estate, or mortgagee, lien holder, or other business entity."

Owner Occupied would be defined as: "A one-family or two-family house or multiple dwelling building used by the owner as his or her or their domicile or principal residence."

The short-term rental space would be defined as: "An entire dwelling unit, or a room or group of rooms or other living or sleeping space, made available to rent, lease or otherwise assigned for a tenancy of less than 30 consecutive days. The term “short-term rental” does not include dormitories, hotel or motel rooms, bed and breakfast inns or lodging houses, as permitted and regulated by the City of Beacon Zoning Ordinance."

Permit would be required, would last for 2 years, and would be able to be renewed.

The application of the permit would be submitted to the Building Department. Several pieces of information would be required, including a notarized certificate from all property owners.

A broad requirement of the City requiring anything: The proposed law also has a line that broadly gives the City the ability to require information not defined in the legislation, with this wording: “Such other information as the City may require.” When two parties are negotiating a contract, statements like this are inserted by a party who wants to cover a large ground of protection. It can be argued that it is up to the other party to accept that or negotiate that statement out of the document.

Permits may be revoked if specified conditions occur, such as an owner not occupying the premises as the owner’s primary residence, or if the property “creates a hazard or public nuisance or other condition which negatively impacts the use and/or enjoyment of surrounding properties, or threatens the peace and good order, or quality of life in the surrounding community.”

Violation fines could be up to $500 per offense. “Any owner who fails to obtain the permit required herein, or otherwise violates any provision of this section, shall be guilty of an offense which shall be punishable by a fine of not more than $500 per offense.”

Attics and cellars would not be allowed to be rented “unless it meets the requirements of the International Fire, Residential and Building Codes or successor law.”

Short-term rentals could be in any zone of the city, and would not be dependent upon the zoning type your house or apartment was in.

Advertised locations: The owner would have to show where they are advertising the listing.

Proof of rental bookings required. The number of days rented would have to be printed out from home-sharing listing websites and shown to the Building Inspector when the property owner(s) want to renew the permit.

Inspection by the Building Department would be required at the time of initial application, and any permit renewal.

Primary residences only are eligible. Owners of short-term rental properties would only be able to rent out that property that they call their primary residence. If it is not their primary residence, they cannot rent out. If they have a second home or house or apartment in Beacon, an owner could not rent it out as a short-term rental.

Campers, sheds, vehicles parked on property, tents, recreation rooms, garages, temporary structures, or other things could not be rented out from the homeowner's property.

Wedding, concerts or other commercial situations would not be able to be rented.

100-day rental limitation has been scratched out. In last month’s draft, there was a proposed limit of 100 days rented per calendar year. Comments from the public indicated this would impact their income, and in some cases, prevent them from making their own mortgage or property tax payments. In the proposed law, there is a strikethrough line through the verbiage, indicating that it is off the table as a restriction.

Timing to get permits: If approved, “This local law shall take effect immediately upon filing with the Office of the Secretary of State. Any short-term rental in existence prior to adoption of this local law shall have 45 days to file an application to obtain a short-term rental permit and 90 days to receive such short-term rental permit before any violations are issued, unless a delay is caused by Building Department in not issuing said permit.”

General Tone of the Legislation is Assumptive of Rowdiness - But Airbnb-ers Have Attracted Quiet Renters

In this proposed law language, the City's position takes an approach that defends the citizens, and one that assumes that renters are likely to be disruptive. Setting the stage for the legislation, the following is written into the introduction of the proposed law: "There is a greater tendency for Short-Term renters to fail to conduct themselves during their occupancy in a manner that respects neighbors and the community as would persons with longer standing relationships to their neighbors. In addition, studies have shown that short-term rentals are linked to increases in rent and housing costs because rental units are taken off the market and used as short-term rentals."

Studies, or supporting documentation, mentioned in this statement have not yet been provided or presented to the public for the creation of this law.

During the Public Hearing, all of the people in favor of short-term rentals credited Airbnb itself with creating a good-neighbor environment thanks to Airbnb's background checking and self-governing rules that publicly grade short-term rentals, as well as factor in private feedback. Said a citizen and homeowner landlord, Dennis Mendo, "From renting out an Airbnb for the last 3 years, I have not had one complaint. Not one thing broken. And I live in a cul-de-sac."

During the Public Hearing, it was revealed that people who are renters through Airbhb have to:

  1. Pass background checks from Airbnb.
  2. Can be denied a booking by homeowner short-term rental landlords.

Jessica, a woman who spoke at the public hearing and has a legal long-term rental on the property, also rents a part of the home as a short-term rental. She commented about the neighbor safety in place created by Airbnb's rental marketplace, stating: "I know more about my Airbnb guests than I do about my own tenant."

She went on to explain: "Guests have to go through a three-step verification process that the hosts sets the limits for, that ensures that [the guests] are who they say they are… If anything isn’t fit or isn’t how it was described or is unsafe in any way, shape, or form, they let other potential guests know by giving a lower number of stars and/or giving public feedback or private feedback."

Another attendee of the Public Hearing, Eva, rents her family's home on a short-term basis, and had this to say about her selection process about who books: "We do not accept every booking. We only accept [guests] who are willing to follow our rules. And this is why we only have 10 guests so far since 2017."

The next discussion of short-term rentals is on Monday, April 9, 2018. This will be a Workshop, where the City Council discusses the points it is considering. The workshop is open to the public to watch, but not to participate in. The next opportunity for the public to comment would be during the Miscellaneous Comment period of City Council meetings in general, which usually happen the following Monday.

Secret Gardener Vicki Raabin's Streetscape Project

What's being said more and more about Beacon NY is that the citizens are making it great. While that's a pretty good political slogan, it's ringing true. As one walks by the pleasantries and stops to smell the roses, one may notice they are admiring sunflowers, lavender, basil and other herbs in addition to the potted and hanging floral arrangements that adorn Main Street. What you are witnessing is an "urban streetscape project" by one of Main Street's most known citizens, Miss Vicki Raabin. She is one of several, independently driven, "secret gardeners" that keep the streets looking nice.

In May of 2014, Miss Vicki, most commonly known as the local music teacher and music venue organizer, decided to put some action to her critical thoughts as she walked Main Street and grew dissatisfied with the sidewalk trees. "I got tired of seeing all of the gravel around the trees. My feeling is, if you're complaining about something, you need to step up and do something about it. It bothered me and I felt we could do better."

Raabin started the project a few years ago with small tulip beds. But this year, she committed to herself to "take over small spaces and make them viable again." Working closely with several local businesses on Main Street, Raabin has received strong support from a growing number of storefronts with beds near their buildings, including Tito Santana Taqueria, Towne Crier, Bank Square, Mountain Tops, Beacon Bread Company, and Key Food.

Donations from the businesses have come in an unusual form: egg shells and water from Towne Cryer; coffee grounds from Bank Square and Beacon Bread Company; bags of mulch from Key Foods, more water from Kamel Jamel, owner of Tito's who fostered a partnership with Green Teen by way of putting in the Common Greens Garden at Tito Santana which has a water collection system. Local residents have given Raabin shubbery when splitting plants in their own gardens which is helpful for acquiring butterfly bushes, creeping thyme, lavender and maybe hostas for next year.

Miss Vicki isn't the only one making Main Street beautiful. The potted plants you walk past at major street corners, and all of the hanging petunia baskets are put together by the Tioronda Garden Club, which fundraises for its yearly budget with individual donations and events, like a Wine and Cheese night. In fact, the Tioronda Garden Club gave Raabin some of their flox to act as ground cover for tree plots, as flox is a hearty plant that spreads easily over the years and looks beautiful with masonry.

As for the watering of all of these flowers and plantings, you'll see Miss Vicki pulling her red wagon from the Visitor's Center at beginning of Main Street all the way to Towne Crier where she gets another water fill and picks up egg shells to be used as plant food. But who waters those hanging baskets? Years ago, the hanging plants were on the chopping block down at 1 Municipal Plaza during Mayor Gold's tenure. Then council member, Randy Casale volunteered to do the watering, since the Tioronda Garden Club supplied the hanging baskets through their fundraising efforts. He woke up to drive the cherry picker truck in the early mornings when it was still dark. 

As for now Mayor Casale, he still wakes up early to water.  "I do it because it I believe the beautiful flowers that are put together by the hard work of all the volunteers of the Tioronda Garden Club makes our Main Street vibrant and attractive. This is also a way for me to mentally relax. I would like to thank all our volunteers who help to keep our city the city that it is."

Gardening certainly is relaxing. And right now, it's helping Beacon to stay original and special as a train town along the beautiful Hudson River. Secret gardening is offering ways for citizens to dig in, literally into the earth of Beacon to keep it vibrant and ever-changing.



Rite Aid Gets Upgrade - And Sliding Front Doors!


Rite Aid, in the middle of Main Street, across the street from the wine store and Yanarella Dance Studio and the Dance Bag, has gotten an upgrade. Such an upgrade in fact, that this Rite Aid is unrecognizable from its former self, and is now on par with suburban drug stores that offer sliding front doors, wide open isles, and plenty of walking room. According to a post at Wigam, Rite Aid leased the space next door, a formerly empty auto parts store, and the space behind it near the parking lot for more storage.

No matter what your preference in local business, a fancy Rite Aid is certainly better to look at and walk through. Rite Aid was one of the more challenging stores to get into with a wheelchair or single or double wide stroller. The clunky, crowded, two-door system made getting in to grab something quickly quite a challenge. Not to mention the poles in the middle of the office supply isle, making shopping with a stroller or wheel chair down that isle impossible. Now, the front doors slide open and there is a lot more breathing room.


To spread the wealth, my primary pharmacy remains with Vogel, where I've learned first hand that prescriptions can be transferred within moments of a phone call between pharmacists at different pharmacies in different states.


Stocking the shelves continues, with new surprises on the shelves weekly. The school supply isle leaves room for more, as Walgreens still corners the market on most eye-candy-ish school or office supplies (at the drug store level...Target is the most fun), but as you can see, there are plenty of items to shop for, from diapers to batteries to makeup. Just as there were before, only now you won't be so claustrophobic when you run to the drug store for a bottle of laundry detergent.


Yes, you could pick up breakfast, lunch, dinner and dessert at Rite Aid if you so desired. You will find the regular, big name brand items like Ben & Jerry's and Blue Moon. You won't find local names or craft beers, but there are plenty of other options to find unique brands like at The Hop, Beacon Pantry, KeyFood (artisan brands have really increased on the shelves here), and even the convenience store in the Beacon Dental plaza who carries a large beer selection and occasionally organic milk.

 Price-wise, Rite Aid has never been cheap, and prices itself on convenience. This Suave shampoo (the Aveda version), which is on prominent display at the front door, is $4.29, which is $3 more  than it is at Hannaford on Rt. 9. But - the convenience is nice.


The fun isles, for toys, costumes, and greeting cards remain, and have more choices in them, including greeting cards. A lot of greeting cards actually, and now party packaging supplies.

All in all, we're stepping up in the world! It's a pleasure to walk through and shop in the new Rite Aid!

Beacon Architect Aryeh Siegel Featured in Upstate House

One of the most exciting aspects of living in Beacon, NY is that we are living during a historical era. When my family moved here, our neighbors across the street had moved here twenty years prior, also from Manhattan, to raise their family. They moved during the height of drug times, when Main Street was boarded up. The first investment they made to their home was installing a giant chain link fence around their entire property to keep people from sitting on the front stoop of their home to do "business".

Today, Beacon is the playground to many architects who are changing the face and experience of this city, while taking delight in "existing structural elements that can be incorporated into new uses." Such statement was spoken by Aryeh Siegel in an interview with Peter Aaron for Upstate House magazine. The article proclaims Siegel to be Beacon's architect laureate thanks in part to the number of game-changing projects he has been involved with crafting and reinventing, including Dia:Beacon, the Roundhouse at Beacon Falls, the Towne Crier Cafe, the Beacon Dog Park, the Beacon Cultural Community Center, and a growing list of other residential and mix-ed use sites.
